As part of its business operations, The Peoplease Group (“TPG”) may collect, receive, store, use, disclose, and otherwise process personal information provided in connection with Short Message Service (“SMS”) or text messaging communications. Such information may include a mobile telephone number, name or other identifiers provided by the individual, the content of text messages, delivery information, message interaction data, and related records needed to document consent, provide requested communications, maintain security, and administer the messaging program.
TPG will collect and use SMS-related personal information only for specific, explicit, and legitimate business purposes disclosed at or before the time of collection or otherwise permitted by applicable law, including to respond to inquiries, provide customer support, deliver service, operational, transactional, payroll, employment, benefits, account, security, or compliance-related notifications, send marketing, promotional, recruiting, or informational messages to individuals who have provided the required consent or who are otherwise permitted to receive such messages under applicable law, deliver surveys and solicit feedback, measure engagement with and the effectiveness of TPG’s messaging communications, verify identity, maintain records of consent and communication preferences, prevent fraud or misuse, and support internal administration, auditing, legal, and regulatory obligations.
TPG will not use SMS-related personal information for purposes that are materially different, unrelated, or incompatible with the disclosed purpose of collection unless TPG first provides any notice and obtains any consent required by applicable law.
Categories of SMS Personal Information Collected
TPG may collect the following categories of personal information in connection with SMS communications, to the extent applicable:
- Identifiers and contact information, such as mobile telephone number, name, employer, employee or applicant status, and account or employee identifiers where relevant;
- Communication contents, such as the text of messages sent to or from TPG, attachments or links voluntarily provided, and customer support or service history associated with the SMS exchange;
- Internet or electronic network activity information related to the messaging program, such as delivery confirmations, timestamps, carrier or routing information, device or platform interaction data, opt-in/opt-out history, communication preferences, and engagement metrics such as link clicks, response activity, and message-category subscription status;
- Professional, employment, or commercial information where relevant to the communication, such as job application status, payroll or benefits alerts, account administration, client service requests, or employment-related updates; and
- In limited circumstances, sensitive personal information contained in the communication, but only where necessary for a disclosed and lawful purpose and subject to applicable restrictions.
No Sale; No Sharing for Cross-Context Behavioral Advertising
TPG does not sell SMS-related personal information. TPG also does not share SMS-related personal information for cross-context behavioral advertising or disclose mobile telephone numbers to third parties for their own marketing, lead generation, advertising, data brokerage, or other independent commercial purposes. TPG does not use rented, sold, or shared opt-in lists for SMS programs.
Any disclosure of SMS-related personal information is limited to: (i) service providers, contractors, subprocessors, and platform providers acting on TPG’s behalf and under contractual restrictions; (ii) affiliated entities where reasonably necessary for internal administration and legitimate business operations; (iii) parties involved in a corporate transaction, subject to appropriate confidentiality and use restrictions; and (iv) governmental, regulatory, judicial, or other third parties where required or permitted by law.
Service Providers, Vendors, and Processors
Where TPG uses a messaging platform, cloud provider, customer support provider, analytics provider, or other vendor to facilitate SMS communications, such party may process SMS-related personal information solely on TPG’s behalf and only for the business purposes set forth in TPG’s contract and applicable law. TPG requires such parties, as applicable, to provide reasonable confidentiality, security, assistance, deletion/return, and use-restriction commitments and prohibits them from selling or sharing SMS-related personal information or using it for their own unrelated purposes.
Data Minimization, Purpose Limitation, and Retention
TPG applies data minimization and purpose limitation principles to SMS-related personal information and seeks to collect, retain, and use only the information reasonably necessary and proportionate for the relevant disclosed purpose. TPG retains SMS-related personal information only for as long as reasonably necessary to fulfill the purposes described above, to document consent and opt-out activity, to complete transactions or communications requested by the individual, to detect or prevent security incidents or misuse, to comply with legal obligations, or to establish, exercise, or defend legal claims, after which such information will be deleted, de-identified, or otherwise disposed of in accordance with TPG’s records retention practices and applicable law.
Consent, Program Disclosures, and Opt-Out
TPG will obtain any express consent required under applicable federal and state law before sending SMS messages. Where required, consent will be obtained through a clear and conspicuous opt-in that identifies the sender, describes the nature and categories of messages the individual will receive, discloses that message frequency may vary, explains that message and data rates may apply, notes that messages may be sent using an automatic telephone dialing system or similar technology where applicable, and provides clear instructions for obtaining help and opting out.
For marketing or promotional SMS messages, TPG will obtain prior express written consent where required by applicable law. Separate consent may be requested for distinct categories of messages (for example, service and transactional notifications, account or employment-related alerts, recruiting communications, and marketing or promotional offers), and individuals may opt in to some categories without opting in to others.
Individuals may revoke consent and opt out of SMS communications at any time by following the instructions in the message, including by replying STOP where that functionality is offered, by adjusting their communication preferences through any preference center or account setting TPG makes available, by using other reasonable methods that clearly communicate a request to stop, or by contacting TPG through the methods identified in its privacy notice or messaging terms. Where TPG offers more than one category of SMS messages, a STOP request will be applied to the category of message from which it was sent, and individuals may separately manage their preferences for other categories. TPG will honor opt-out and revocation requests within the time required by applicable law and, where permitted, may send a single confirmation message confirming the opt-out. Individuals may obtain help, where supported, by replying HELP or by using the contact methods identified by TPG.
Individuals who receive services from TPG and who opt out of marketing or promotional SMS messages may continue to receive non-promotional administrative, transactional, service, security, payroll, benefits, employment, or compliance-related messages necessary to deliver the services or satisfy legal obligations, from which the individual cannot opt out while continuing to receive such services.
Consent to receive marketing or promotional SMS messages is not required as a condition of purchasing any goods or services or of obtaining or continuing any employment relationship, except where otherwise permitted by law and clearly disclosed. TPG will maintain records of opt-in, opt-out, and preference-change activity to the extent reasonably necessary for compliance, auditing, and dispute resolution.
Marketing and Promotional Messages
Where permitted by applicable law and the individual’s communication preferences, TPG may use SMS to send marketing, promotional, recruiting, informational, and relationship-management messages, which may include information about TPG’s products, services, offers, events, surveys, customer-satisfaction requests, company news, and related content. Marketing messages may be sent based on the individual’s opt-in consent or, where permitted by applicable law, based on an existing business or employment relationship and in accordance with any further limits required by law.
Marketing SMS messages may be sent using an automatic telephone dialing system, pre-programmed or recurring messaging technology, or a third-party messaging platform acting on TPG’s behalf. Message frequency varies based on the type of program, the individual’s preferences, and interaction with prior messages. Standard message and data rates from the individual’s mobile carrier may apply, and TPG is not responsible for carrier charges or for any delay or failure in message delivery caused by the wireless carrier or network.
Messages may be sent from a range of telephone numbers, short codes, or sender identifiers associated with different categories of communication (for example, separate senders for service, security, recruiting, or marketing messages). TPG uses reasonable efforts to ensure sender information is accurate and up to date but does not guarantee it. Where TPG makes a preference center, account setting, or similar tool available, individuals may use it to review and adjust the categories of SMS messages they receive at any time.
TPG does not use rented, sold, traded, or shared opt-in lists for SMS marketing programs, and it does not authorize its service providers to use mobile telephone numbers provided to TPG for their own independent marketing purposes.
Consumer Privacy Rights
Depending on the individual’s state of residence and the applicability of state privacy law, individuals may have rights with respect to personal information collected through SMS communications, including the right to know/access, delete, correct, obtain a portable copy where applicable, opt out of sale or sharing, limit certain uses or disclosures of sensitive personal information, appeal a denied request where applicable, and be free from unlawful discrimination or retaliation for exercising privacy rights. TPG will honor applicable rights requests in accordance with governing law, subject to permitted exceptions, verification requirements, and recordkeeping obligations.
TPG will not require individuals to create an account solely to submit a privacy request, and any identity verification requested in connection with an SMS-related privacy request will be limited to information reasonably necessary to verify the request and protect against fraud or unauthorized disclosure.
Security and Monitoring
TPG uses administrative, technical, and physical safeguards designed to protect SMS-related personal information against unauthorized access, acquisition, disclosure, alteration, loss, or misuse. Such safeguards may include role-based access controls, authentication measures, logging and monitoring, vendor management controls, secure transmission and storage practices, incident response procedures, and other measures appropriate to the nature of the information and the risks presented. TPG may monitor messaging activity for quality assurance, security, compliance, training, fraud prevention, and operational support to the extent permitted by law.
Children and Sensitive Information
TPG does not knowingly use SMS programs to collect personal information directly from children where prohibited by law. Individuals should not send Social Security numbers, bank account credentials, health information, or other highly sensitive information by SMS unless specifically requested by TPG through an authorized process and permitted by law. To the extent sensitive personal information is collected in connection with SMS communications, TPG will use and disclose it only as reasonably necessary for permitted business purposes or as otherwise authorized by applicable law.
